So much for unions to support them for mid term elections.. Come next year, if dems still have same majority, H1B/L1B word will be removed from India's IT dictionary..
All they had to do was to introduce another $2000 fee for every Green Card Re-Captured. Most of us would have been out of this mess and they would have got the money they needed. This Grand posturing is extremely disturbing and i hate the politics behind it.

something really strange is going on:
I485 EB2 filed at NSC Dec 3,2008, and on Feb,18 received RFE(!) requesting employment verification, divorce certificate, W2 and some other stuff that has been posted to them just 2 months ago.:confused:

03/15/2006: Possible Full Senate Debate Mark-Up Beginning From March 20, 2006
An unconfirmed sources of information has just released a report that the Sen. Bill Frist, Majority Leader is pushing a two-week full Senate floor debate beginning from March 20, 2006 rather than March 27, 2006. This report is indirectly supported by another news that the Senate Judiciary Committee is pressed to extend their additional mark-up on Friday, March 17 to finish up the Committee action before the end of the week.

Senate Judiciary Committee is scheduled to pickup the Sen. Specter's Mark of the Comprehensive Immigration Reform bills today. Initially it was scheduled for two days, March 15 and March 16, but the AILA has just obtained the information that the Committee has tentatively extended the mark-up on March 17, Friday as well in order to finish up this business within this week. As we reported earlier, the Committee has been working on a tight schedule because of the pressure from Senator Frist, the Majority Leader of the Senate to start debate on the Comprehensive Immigration Reform in the Senate beginning from March 27, 2006.
Now is the time for everyone to pickup the phone or send emails to the Senate Judiciary Committee members to urge them to support the bills. Otherwise it will be too late.

Thank you 'lazycis' for reconfirming this. Just 2 weeks back I used to think that keep working on H1B is lot safer than using EAD :o
H1B petition can be revoked automatically if a) employer notifies USCIS that the petition is withdrawn or b) employer goes out of business. See 8 CFR 214.2.(b)(11). So yes, EAD is much safer in this regard. Revoked H1B petition cannot be used for transfer/extension. It's nice to have H1B as a fallback, but it's not a safe heaven.

Since it passed during the special session, everything had to be cleared out of the Congress quickly, I guess. USCIS must be busy to get ready for processing and collecting increased fees from these employers soon. The new filing fees will be a huge amount, especially when they decide to file a premium processing request. Can you imagine how much these employers will lose for a single case if the case is filed on premium and denied!! Ouch!

I thought I will share my experience with all members who are facing processing delay for their I-140. My I-140 was filed at NSC on March 21, 2007 and got transferred to TSC on May 21, 2008. Since then, I see no activities (I believe TSC was treating transfer date as receipt date and they didn’t bother to look at my case). On July 29, 2008, I asked my Lawyer to initiate the inquiry about the delay and his paralegal took the “service center request” from USCIS for my I-140 and service center issued a confirmation number (ETCXXXXXXXXXXXXX) for further inquiry.
Within 10 days of initiating the inquiry, my case was approved on August 9, 2008. Please do so if you think it will help.

Why can't we have a fax campaign like NumbersUSA and fax the respective senators.
I think when it is re-introduced again we need to flood the nay/abstained senators with faxes asking them for changing the vote.

There are plans on IVs agenda to see if we can collectively help ourselves on these issues.
I recommend all members to use every channel you get to fix issues like these.
We are entitled for a fair process and we must make sure every application is treated in a fair manner.

All of us are passionate and sometimes this passion overtakes logic. If you are fed up with USCIS, suing them or putting pressure on them through Congress/Legislature/Press are the only options.
You have seen what happened to the Ombudsman and his reports. Year over year, same findings pile up in his reports and he finally left. If someone who has internal access to USCIS workings and has a mandate to change USCIS functions to benefit us - the paying customers, could not relieve inertia of USCIS, I suspect you and I do not have much of a chance.
Courts and judges are definitely going to punish USCIS for any quantifiable losses suffered by us. If you can find any, sue them.

Not really h1b is a different track all together. If 485 is denied and the denial is final - person is still free to work till h1b expires thats why lawyers say h1b is safer
This is exactly my lawyer mentioned, AOS deined, you are still good to continue work (and wind up in USA) till your H1(i-94) expires. Hence, it is deemed as "safety". Person gets time to windup before the final bye-bye.
