Dear Attorney,

i would like to join a very good opportunity on EAD but have one concern shown below.

"a person has a valid ead/ap and he is gone outside the country for some work purpose and uscis denies his 485 in an illegal way like for eg: (denying AOS applications that have been pending more than 180 days when an employer revokes an I-140). how will he enter USA then ??
can he file MTR when he is outside the US with the help of a lawyer ?"

Just spoke to an IO at TSC, She told me that the case is at a place what they call "Pending Review and final decision"

I asked her whats the next step after this?
IO : Hope fully will be assigne to some one

I Asked, isn't this the place where all the cases are "Pending Review and Final decision"?
IO: a big NO...no no..this is not the place where all the cases are, I can't provide anymore info then this, I was just being nice because you called at 3:30 pm.

Any body who has thier case in the pool of "Pending review and final decision".

Honestly, I think its just a general status that she told me about my 485 case.

An employer did H1 processing for Ms.A on US Masters degree quota in 2007, but she decided to go back to school before the H1 kicked in (communicated the same with H1 sponsor/Employer) and is getting the degree (PhD Engg) in Aug 2010. Ms. A never worked on H1 and continued to be a full time student(made the mistake of telling the university about H1).
FYI: Ms. A traveled to home country and got back on F1 visa in Aug 2007
What solutions does she have now?

1. Get a job, continue on H1 and extend it?
2. Get back to F1 ( graduate in December instead of Aug. Really difficult to find other schools giving I 20 now!)

(Ms.A may have to visit home country this year for personal reasons and visa stamping is required to get back to US!!!)

Is there any other solution?
Do you think consulting two different lawyers is helpful in this situation?
How much may be the Attorney fee ?

Hi,
Recently I transferred my H1 to another company. My H1 and my wife�s H4 got expired on last August 2nd 2007. However, the new company filed H1B application and it got approved 2 weeks back, but forgot to file for H4 extension for my wife. My company is saying they will file for H4 extension (I-539) now, even though her visa/I-94 got expired and she doesn�t have to go back home. Do you think they are on right track? I�d really appreciate if anyone could suggest me on this.

Hi,

My wife is on H1B and she couldnt work for the past 6 months. I applied for my I 140 and I 485 during the July fiasco last year and she was not added as my spouse and we got married at a later date.

Since she didnt receive pay for 6 months, I guess she is out of status for these 6 months. So my question is will this have any effect on her GC process when I add her as my spouse to the I 485 application whenever my priority date become current ? I am really worried and dont want to screw up my GC process after a long wait.

Yes, it can be transferred. Fees will include a fee for I-129 ($320) and a fraud prevention fee, which is $500. The employer fee is waived if the non-for-profit company qualifies as non-profit under the U.S. immigration laws.

My Original PERM labor certificate was lost in mail so we filed my I-140 without the PERM LC and asked USCIS to obtain the certificate from DoL. USCIS got the labour certificate from DoL and sent the original LC to us as an RFE to get my employer's and my signature on the perm certificate. My employer by mistake signed the labor certificate where I was supposed to sign :(. We have now covered his sign with white paint and I would be signing at correct place and sending back to USCIS. Do you think any white ink or over writing on original PERM certificate would matter in adjudication of my 140?

Hello -

Can anyone suggest if there is a way to check the priority date on a I-485 application after an interfile request has been made? I am not sure if a call to the Service Center is the only way, or if there is a form I can submit requesting this information.

The context of my question is this: My original I-485 application was filed based on a LC/I-140 approved by PERM with PD May 2005. But later, as part of backlog elimination, an older LC for me with PD Aug 2004 was cleared and my company's immigration law firm got another I-140 approved based on this earlier LC. They've told me that they contacted USCIS with a request to get my I-485 attached to the older PD. I would like to get this confirmed since a 9 month gap in PDs can easily translate to years more of waiting time.

Thanks in advance to anyone that can help out or suggest if I should be doing anything different with getting the PD of my I-485 changed.

If i get you right, what you are asking is H1 to F1 conversion, why it is not possible ?

It is possible provided if one is maintaining his or her H1 status, till requesting to convert to F1.

PS: Advising based on my knowledge, not a legal advice.
