Can I change to different employer while the i140 is pending and also keep the PD. What i would like to do is..i want to change to a different employer and ask the present employer to keep the i-140 process as it is.
Is it ok if the i-140 gets approved while i no longer work for that company. I understand if i get any RFE, then employer need to respond accordingly.

Hello Gurus ,
I am looking for H1 Transfer with 4 months left in H1 six year limit .I lost my job 10 days back.I have approved I-140 but its has not been six months yet after approval .I have not yet filed 485 .
Will I qualify for 3 year H1 extension based on my approved I-140 .?

If anyone of you here in SAP, Oracle apps, JDE...this might be useful. I have APICS CSCP (Certified Supply Chain Professional) books all four volumes in very good condition. My Original PERM labor certificate was lost in mail so we filed my I-140 without the PERM LC and asked USCIS to obtain the certificate from DoL. USCIS got the labour certificate from DoL and sent the original LC to us as an RFE to get my employer's and my signature on the perm certificate. My employer by mistake signed the labor certificate where I was supposed to sign :(. We have now covered his sign with white paint and I would be signing at correct place and sending back to USCIS. Do you think any white ink or over writing on original PERM certificate would matter in adjudication of my 140?

if i enter current employer is it ok to enter school name in 33...

I was H1B, but used AP return to the U.S. the same company, but when I filed the new I-9 form after return, the company lawyer asked me to write EAD and EAD expiration date, so I guess I am AOS now? or not? I am not sure. My company will resume my H1B this month, but don't know when it will be completed.
Now I am going to e-file EAD renew.There are some questions in the form I-765 that I am not sure how to answer (The lawyer has completed his 140 and 485 document, so he doesn't want to answer now.):
1, Manner of Last Entry into the U.S.: Should I choose PAR (PAROLEE) or H1B (SPECIALITY OCCUPATION)?

There maybe actions such as sending emails etc. However we would not be able to open a public action item unless we can have thousands of our members willing to participate in a grassroots action item. This survey intends to understand the needs of our membership for this provision and collect grassroots information.
The fact is we have a dedicated group of volunteers (and we need more) who have been trying their best to spread the message about this initiative so that a strong grass-roots support can be created leading up to launch of the public action items. So far we have around 1100 people who have responded. Based on quick calculations carried out using PERM data, it is estimated that there are at least 60K-70K EB applicants waiting to file I-485/EAD/AP (this is a very conservative estimate..the actual number could be much more). Grass-roots initiatives require time and patience and we request maximum number of impacted folks to participate actively.

All,
My 485 was filed during the Jul 07 fiasco. My 485 online status became " fingerprinting fee has not been received and case will resume only after we get....". We even got a letter from uscis in oct 07 about this.
However we got a letter from USCIS again in Nov 07 that it was an error on their part and asked us to ignore the letter.
However the online staus remain the same.
Fingerprinting was done in sep 07, got couple of EAD's and AP's as well.
I have travelled once in AP and no issues.
Is there anybody else with the same situation?
Should i call the customer service and enquire?
Please advise.

I started to notice this back in 2006 when the immigration debate was heating up in Washington. I was getting those annoying email forwards and this time they were of the Lou Dobbsian anti-immigrant variety. The surprising thing to me was that most of them were coming from older family members or acquaintances in the senior citizen set. My friend's company is India recently applied for his L1B visa. He is scheduled to go for stamping next week. But, another company has already premium-filed his H1B petition and is expected to hear back from the USCIS anytime now.
Here's the question: if he gets his L1B visa first, can he later on try and get his H1B visa and enter the country with the H1 visa? Second, if he goes for H1B stamping right after his L1B stamping, will it affect the visa officer's decision in issuing a H1 visa?
Last question: he has already spent 3 years in the US on a L1B visa. So, if he comes here on a H1B visa, will the 6-year term limit count his 3 yr. stay on L1 visa or will a new clock start when he enters on H1?
Please chime in if anyone has done this before or has any insight on this matter.
