EB3 is totally doomed. They are not even approving 140s for EB3, visa number issues come later. Although I've been doing it, I seriously didn't come here to spend my time writing letters just to get one simple application processed for which I'm overqualified (I am qualified for EB2, but my company pushed me into EB3). And yes, that doesn't work either. USCIS does have time to draft and send back a reply to the congresman but not to look at my simple and sweet case.
If they (USCIS) don't know what they are doing, who are we to educate them?

Not really, The PD will be stuck sometime in 02 or 03. Thus, unless there are some changes in law, we are looking at 5-7 years wait.
Also, I am not fabricating 750,000 number. This is the anticpated applicants, per Matthew Oh.

If the GC quota is 9800 for India then to process 750,00 applications ( most of them will be India I am sure ) will take like 20 years . Thats impossible man !!!

Feb 07 2008 I made an infopass appointment and saw an IO he accepts my request to expedite. Finally I get a LUD saying Documents mailed to applicant on Feb 20 2008. Then on feb 21 2008 I see a soft LUD Till today I have not received the AP. Do you thinking making an infopass appointment and requesting a copy will help. The problem is I should have been in Canada on the 9th. I don't know what else to do. This is ridiculous. Gurus please an suggestions:mad: This case was filed with the Nebraska Service center.

I don't see Visas Recapture bill going any where.
It seems USCIS wants to potray that they are doing great job by doing various Process improvements. USCIS indirectly wants to say that eventually USCIS process will be improved to the extent that there will be no Visas wasted.
I think this was the most straight forward and simple bill. Other bills like removing the country limit are more challenging.So I don't see anything happening from immigration point unless democrats take over both senate and House in late 2008.
Hope for any legislative changes only in 2009 and beyond and not in 2008.

I feel that initiator of this thread is not trying a coup d'�tat. He is merely pointing to the fact that every organization runs by elected officials. Having a life term president and core group is only heard in autocratic systems but not in a democratic one. What are we as an organization?
Why are we afraid of discussing new ideas? Why shouldn't we open up IV organization for elections? There is nothing wrong in declaring the rules and then playing by those rules.

Other than that RD also comes into play in deciding the order in which the file comes under review of an officer. This is irrespective of what the visa bulletin says..and is called in CIS parlance as pre-adjudication if the PD is not available.("pre" as in adjudication before a visa number is available).
Such files that have undergone adjudicator review/FBI name and fingerprint as well as IBIS checks and are complete in all other respects but for visa# are now placed in separate area shelf for quickly assigning #'s, stamping, signing and ordering cards when PD is current for such petitions.
So the work of reviewing files goes roughly in FIFO order (that is based on RD) all round the year whether the bulletin says C, U, A, B or JAN01STONEAGE!

thats why aila lawsuit is important, if they can bend the rules for consular processing and a lot of other mischief for eating up 60k visas then they can bend there rules for giving us EAD as well when bulletin is revised.
See what I was saying. They are not supposed to grant CP appointments and approvals in July per the regulations. They have decided to bend the rules to approve the currently pending 485s and CPs. They came up with this lame excuse that since the visas were already shipped out to the consular posts ................yada yada. Point is as I said they can't do 18K CP applicatrions in a day at the consulates the way they seem to have done for the 485s. Even this I am not sure.
I doubt whether they have sent out all 60K 485 approvals either, they probably will in the course of the next month or thereabouts.
I'll say it again, they want 485s out but they don't want them in for whatever reason. It is getting clearer.

I see that most of the people who initially responded to my first post about the southern california state chapters have some recent activity i.e. they have visited this website in the last 2 days after my last posting requesting you to e-mail me about your availability for a conference call today. Not one of you has responded to my request to e-mail me.
I just want to make you all aware that IV core members can do a limited amount of work. They are definitely not superhumans although we expect them to be as such. If we fail in our efforts to secure any retrogression relief we will have only ourselves to blame in such a situation. Besides this is a very ripe time to be active and talk to politicians here in Southern California region. I would like to reschedule the conference call for the coming week/weekend depending on your availability.
In the end our best intentions and best wishes are not going to get us the immigration relief we want. We also cannot blame IV core team if we do not start working and lending them a hand. The choice is clearly ours. I hope that all of us will be more forthcoming and open to spending some time on IV work in the future.

IV is not IV core but each and every member of IV and efforts are needed from each member in order to succeed. Jimi, pls send PMs to all members on the thread requesting them to get in touch with you so that you can organize state chapter activites.

This is an excellent thread. It's something I've been looking for for a long time. I am still not clear about using AC21. Here's my situation.
July 2nd filer. Received EAD for me (primary) and my spouse. Waiting for I140 approval. I understand it's risky to invoke AC21 before I140 approval. After I get it approved, here's what I intend to do.
1. Inc a business in my spouse's name.
2. Invoke AC21 and join my spouse's company as a "Software Engineer" (my position in LCA)
If I do this, during I485 adjudication, all I need is an offer letter from my spouse company saying that I am working as a Software Engineer right?
Also, does USCIS care during I485 adjudication whether I got paid continously while employed with my spouse's company?
If for any reason, I decide to quit my spouse's company before I485 adjudication and move to a different company, Will I be able to do this?

Here is my point. I spend several hours 3-4 hours at least every day looking through the forum posts hoping to find ways i can contribute to efforts. There are several ideas that are generated in the forum. But cannot find out who is leading it. All i am saying is if we can have a listing of initiatives with some names associated. So i can contribute to the ones that i can support. I am not sure if i am asking for too much here. I am not a IT guy. I do not know what it takes to post it in the front page.
