Hello, I apologyze for not giving my name away first of all, secondly I need to know what my options are if my father and mother who are permanent residents in the USA can file an I-130 for me? They obtained their legal status thru the department of labor but at the time they were approved I was already 21 years of age (the whole process started in 2000and lasted for 5 years or so); one lawyer told me that I cannot do anything since I was over 21 but I just have been in a different lawyer who told me that yes I can adjust my status thank to a grandfather law that can help me to achieve my goal in working legally in this country. I am an unmarried daughter and 27 years of age at this time.
I just don't want to spend those $5,500 can this lawyer is asking me for his services, I appreciate very much your replies and my family will too

Our Application was also received by M.Salcedo at TSC on August 2nd. We got all our receipts on October 1st. When I checked the status online for 765, the status showed - 'Card Production Ordered'

I have got H1B after long long wait from L1B visa. I work for an MNC from the past 6 years. (5 yrs in usa and 1 yr in india). I came on L1B visa to Usa and applied for a green card EB3. My 140 is cleared in 2008 and 485 is pending(My employer says pending but not sure about that as he did not give me the reciept number). My job role is architect and leading a team of 14. But getting peanuts like 58k. I have lot of debts and clearing from 2 years and presently my credit history is recovering back to normal. Presently managing with debit cards...

Employer A - LC applied in Dec 07, Currently on 7th year extension till Jan 2010. Stamped visa.
Employer B wishes to recruit me by transfer H1-B and utilize recapture time. The total time they would get is till Apr 2010 (which includes recpature time) along with 7th year I-797.
Employer B wishes to file LC 1 month after I join them.
Assuming that I join them by end of Dec 2008, I have the following questions about my H1-B extension
Lets consider Dec 30th as the date to start the LC application.
What I understand is that based on the LC from Employer B,
Can I get extension on my H1-B beyond APR 2010.

Hello Gurus ,
I am looking for H1 Transfer with 4 months left in H1 six year limit .I lost my job 10 days back.I have approved I-140 but its has not been six months yet after approval .I have not yet filed 485 .
Will I qualify for 3 year H1 extension based on my approved I-140 .?

I have filed an appeal for a rejected I 140, which is I 290B.
I also filed a new I 140 using the same labor (EB3, august 2003)
Now I am seeing constant changes to LUDs to both status online, but the text doesnt change.
I 290B had LUD change for 3 days, and I 140 had LUD change for 3 days too.
I am confused now... does this mean they are working on the case?
constant changes like these furstrate me when there is no message or text change in status.
Can the gurus here predict according to similar trends? what can I expect?

I Just learnt that the Name Check for my I-485 was processed under a different Alien number when it should be processed by alien number assigned in I-485 case. Since it was cleared under a different number (probably the one for I-140), I-485 file did not have this information and now they are getting it fixed. So when everything in my case is current, this came up right at the time when they will almost be getting out of visa #s. :(
I recommend you should all contact your service centers where your I-485 was filed and make sure that yoru name check is in process or got processed under correct alien number. If the service center refuse to provide any information, contact your congressman office and have them verify this information. You can find who is your local congressman by going to http://www.visi.com/juan/congress/.

Hello everyone,
I obtained my F1 visa in Aug,2001 for 5 years and I initially came here for M.S. I have continued for PhD in 2003 and visited India every two years. My F1 expired in Jul,2006 but my I-20 is valid until Dec,2008.The real problem is that I have applied for Canadian PR this Oct and expecting to get it by Oct,2008.
Once I get my PR, I have to go to Canada for Visa stamping and my questions are related to this:
1) Since my F1 expired, Can I come back to US after PR stamping, without needing an F1 visa.?
2) Is it advisable to get my F1 visa stamping in India or Canada next year i.e in Oct 2008, or would it be too late? (since that would be two years after visa expiry).
PS: I wanted to get my F1 stamping only if it were necessary to go to India.
Any suggestions would help me a lot and thanks so much in advance.

I wish to share my experience at POE at Newark Liberty International Airport. This may be helpful to others.
I came back to US on last Sunday on AP/EAD.
There was no issue at all while entering on AP. In fact, there were several AP/ h1B candidates. Everyone was having smooth entry.
Immigration officers were asking everyone to relax and calm down.
One person ahead of me had first and last name completely switched on I-485 and EAD than from passport.
He explained that his first and last name got switched while GC filing.
After little investigation , he was also allowed to enter by immigration officers.
Overall my experience was very good about immigration at POE.
No need to afraid if we have proper documentation.
People are unnecessarily spreading panic and rumours.

I believe working on 1099 is allowed when you have the full time work on H1B going.
There are different types of 1099. 1099-Misc is not allowed. 1099-Int , 1099-G are the examples of allowed 1099s

Okay anyways, here is my entry. I drew this from a picture that was taken of me (left obviously) and my cousin in Disney World last June.
I'll scan it once I get my printer/scanner/cappuccino-maker all set up (just moved into a new place). I'll also scan the original photo so you can compare.
Anyways, I thought it turned out well, although I kind of look like a zombie and all my fingers look sort of broken. :lol:
