When my employer looked up my case number on the DOL site, the case status showed as "certified" and apparently when he downloaded the certified ETA 9089 the section where it says "Signature of the certifying officer" doesn't bear CO's any stamping/signature.
My employer came to know this only yesterday obviously 'coz he overlooked and we just have two more months remaining on this PERM validity. My employer also said he can't file for I-140 unless we hear back from the DOL on the CO signature issue.
He has apparently emailed DOL asking for clarifction on this.
1. Would DOL even bother to look at the incoming emails after the case has been approved?.
2. Does CO's rubber stamp signature really required for 140?. What if we don't hear back from DOL on time, can we just go ahead with 140 filing?.
3. I am on my 6th year of H1b.
Any response on this matter is truly appreciated.

Once you get married and get your License your spouse can file for I-130, I485 concurrently. You can file for EAD and Advance parole also along with this you need affidavit of support I-824

I took the citizenship test, biometic now the second time .passed it 2 1/2 years ago . I was told the immigration did not have my filed . So Wait. Went to immirgation office 3 times. no result . Case under review ????? what is that mean????? Am confused ... No one can tell me what was going on . I have done no wrong. pay my taxes....

If I file my I-485 through my lawyer, will I have to be with him for all subsequent EAD/AP renewals as well or can I renew them on my own?

Hello All,
i applied my wife's H4 visa renewal on Feb 2008 but received the USCIS Ack as April 2008. when i see the processing times now looks like the processing time for the I 539(H4 Renewal) is October 2007
Does any body have any understanding on the processing times on when my H4 Visa petition would be processed with USCIS ack date as april 2008 . any suggestions would be apreciated

We have applied for our 485 under EB2 I with a PD of Jun 2005 (I am primary and my wife is the dependent). We have maintained our H1B status though have used AP for travel.
Its time to renew my wifes H1B within the next few weeks. With all the talk of spillover and a remote chance that may be our 485 gets approved during the last quarter, i wanted to know if there would be any problem if our GC got approved while the H1B remained pending or worse the H1B got approved too around the same time the GC got approved. [i am hearing that it is taking a few months for H1 approval]
Is there an process that we need to follow - withdraw the H1B once we know that the GC got approved etc.
Also is there any problem with H1B renewal if AP has been used?
Any help wrt both these topics is appreciated.

While President Bush threatens to use his veto pen to stop some bills and Senate Republicans block other measures from even reaching his desk, no force in Washington can halt the Democrats' investigative juggernaut from uncovering the secrets inside this administration.
For the first six years of the Bush administration, these aides were allowed free rein to carry out whatever policy or political assignments they wished -- or supposed that the president wanted done. A Congress under firm Republican control was somnolent when it came to oversight of the executive branch. No Republican committee chairman wanted to turn over rocks in a Republican administration.
You have to feel a twinge of sympathy now for the Bush appointees who suddenly find unsympathetic Democratic chairmen such as Henry Waxman, John Conyers, Patrick Leahy and Carl Levin investigating their cases. Even if those appointees are scrupulously careful about their actions now, who knows what subpoenaed memos and e-mails in their files will reveal about the past?
They will pay the price for the temporary breakdown in the system of checks and balances that occurred between 2001 and this year -- when the Republican Congress forgot its responsibility to hold the executive branch accountable.
It was a fundamental dereliction of duty by Congress, and it probably did more to encourage bad decisions and harmful actions by executive-branch political appointees than the much-touted lobbying influence. In reality, many Republican members of Congress did not mind what was happening because they were able to get favors done in that permissive climate. Now, the Democratic investigators will publicize instances of influence by members of Congress, and the political fallout will not stop with New Mexico's Pete Domenici and Heather Wilson.
Democrats find it easier to investigate than to legislate. With their major initiatives, from a minimum-wage boost to a shutdown of the Iraq war, stymied by Republican opposition, the Democrats are understandably making "accountability" their new goal -- meaning more and more investigations.
Fulfilling that promise, later in the week the House passed a series of bills that stripped some of the secrecy from executive branch documents and decisions.
Accountability is certainly important, but Democrats must know that people were really voting for action on Iraq, health care, immigration, energy and a few other problems. Investigations are useful, but only legislation on big issues changes lives.

I have concurrent filed I140 and 485 in Aug 2007. My I 140 is still pending. Can some one let me know what could be the reason. Is there any one whose i140 is pending since last three years.I am worried because processing time is around 4-6 months.Any help in this regard will be appriciated.

I recently got my H1 3 yr extension based on I-140 approval, I want to change my job to company B but my employer Company A says that he will have to revoke the I-140(as per company attorneys), Will this affect my H1 extension(as in will I be out of status?) and can I retain my PD?
Also does anyone know a good lawyer I can consult over the phone?
