I have replied to my I-485 RFE and the case status on USCIS website has changed from "RFE sent..." to "On June 2, 2009, we received your response to our request for evidence. We will notify you by mail when we make a decision or if we need something from you...."
I am EB-3 India Oct 2004 PD. So not likely that my case status will change to "Approved" any time sooner. Do any one know if the status will change to any thing else before changing to "Approved" ? What I am trying to understand is if the case status will be updated on the website to state some thing that reflects that they accepted my answer in the RFE response.

only for 2 months. You should ask a friend to monitor your mail. Sometimes USCIS just sends FP requests out of the blue. At least you will be able to call and reschedule the FP.

[B]I came to US on March 28th 2008 on H4 Visa and applied on March 29th for new H1B with COS for Oct 2008 quota. I see the h1b approval of I129 petition on Jun 2, 2008 WITH attached I-94 WITH IT. Till today I have not received approval notice from my employer and did not applied for SSN and has not started working for my employer. On contacting my employer they told I am still on H4 status and will be on H1B status only if I apply for SSN. Please verify if tht is correct.Also i dont have any paystubs uptil now.I need your help to understand my status right now in U.S and what is the right action to take now .
My H4 stamp in passport is till Oct 10th 2009 and my husband is right now working on H1B status.

I received RFE that says" your application contained form I-693 in which the required TB skin test was not conducted. Please note there may be conflicting information on some published form I-693 instructions regarding when the chest X ray Report should be performed. It is required only when the TB skin test indicates a reaction equal to greater than 5 mm, or when the reason for why the TB skin test is medically inappropriate to perform has been annotated on theform I-693. Please submit a newly completed form I-693 indicating the results of the required skin test."

After consulting with the doctor they filled up new I-693 from with 2007 test results and gave me in a sealed envelop. I need to know whether 2007 results will be acceptible to USCIS or do I need to do it gain before I submit response. Please advise.

I have two I - 140s pending (say A and B)
I am applying I-485 for A (140)
If my I-140 for A gets denied can I change the I-485 to use I 140 from B later?

When one applies for AP in Multiple entry category they will be given 2 AP dox. lets say if one has used both on travelling like both has stamp of POE can they reuse the same for future travel with in the one year period of validity ?

As expected this happened, but it happened sooner than expected.
This expected sooner because CIR was voted out in Senate and this was not thought about by this goverment.
Basically this was a close door arrangement between govt agencies which temporarily wanted to lower the friction by IV AND SIMILAR GROUPS.
BUT finally I believe this will come to a rest once we have new government next year.
Till that we are a tennis ball which can be tossed to any court.
PS: I dont even have I-140 and not even applied for one.
So best of luck to all and me.

You have informed IV, that is more than enough :D
On a serious note, you just have to inform your (dependent's) employer and provide them a copy of your unexpired EAD. Thats it! The employer may require you to fill a new I9 form.

is this true. My mother came back last year using AP but she never got a new I-94. He AP was stamped and the validity of her stay here. So not sure if you will get a I94 or not. please eloborate.

Yesturday night, I saw Charlie Rose Show, in which he first interviewed Andi Carr and then RAHM EMANUEL Representative (D-IL)....
In the middle of conversation, Charlie asked Rahm about what Dems agree and disagree and how they will work with President. He replied that there is no all disagreement. He said Dems agree on Tax reform as well as Immigration. Then he went on to talk about favoritism to CIR.
It seems like winning the election even while being on Immigration side as well defeat of Representatives J.D. Hayworth and Randy Graf (Hardcore Immigrant Haters) have embolden Dems that Immigration is not as taboo as it was once thought. I have a feeling that they will get this done sooner than later. :)

I originally came here as an E2 dependant but my husband just walked out of his job and had his visa cancelled. My 1-94 is still valid but I am out of status due to reasons beyond my control. He is leaving to go to another country but I am desperate to stay here. As I am out of status, I can't apply for change of status but am scared that if I leave a re-apply for another visa I will be denied because I stayed here out of status..
Can anyone offer any advice? Really unsure of what to do..
