My wife had a H1B working for company A from 08/2003 to 07/2005 (from I-94) and she filed another H1B application to work for company B in 05/2004. She got the notice, stopped working for company A and started working for company B. However, she never got the aprroval notice for the second H1B application. Actually this case is currently still pending. She worked for company B until 07/2005 which is the expiration date of the first H1B. She changed to F2 later in 07/2005. I was wondering if there is any problem about status or employment authorization for this period of time from 08/2003 to 07/2005.

Nina Bernstein, one of the country's best immigration reporters, has a front page story in this morning's Times regarding 30 survivors of the January Haiti earthquake who were airlifted by Marines to the United States and are now sitting in detentions centers in Florida. According to the Times, these individuals were pulled from the rubble and were seeking food, safety or medical care at the airport in Port-au-Prince. When aftershocks struck, the Marines quickly evacuated people via military transports and did not bother with immigration processing. Because these individuals landed without visas, they were taken by DHS into custody and...

    Hello Gurus,
Can we apply for H1 if our I-485 is pending while the current status is L1.

The reason I am asking is I-485 is itself a COS and if we apply H1 while on L1 it is again an COS petition from L1 to H1. So what happens to the I-485 application?

Will there be any impact or no impact at all?

Is there an option to apply without asking for COS when applying H1 with the current status as L1.

    Please help with your views....

Taxes, Health Lead Hill Agenda (http://www.washingtonpost.com/wp-dyn/content/article/2007/09/30/AR2007093001617.html?hpid=topnews) After Iraq Fight, Both Parties Welcome Shift By Jonathan Weisman | Washington Post Staff Writer, October 1, 2007

Out of a political stalemate over Iraq, domestic policy is surging to prominence on Capitol Hill, with Republicans and Democrats preparing for a time-honored clash over health care, tax policy, the scope of government and its role in America's problems at home.

The brewing veto fight this week over an expanded children's health insurance program is only the most visible sign of the new emphasis on domestic issues. Democratic White House hopefuls are resurrecting a push for universal health care while talking up tax policy, poverty and criminal justice. Democratic congressional leaders are revisiting Clinton-era battles over hate crimes and federal funding for local police forces.

The White House, at the urging of congressional Republican leaders, is spoiling for a fight on Democratic spending. And GOP leaders are looking for any opportunity for confrontations on illegal immigration and taxation.

At the heart of it all is a central question: Thirteen years after the 1994 Republican Revolution, has the country turned to the left in search of government solutions to intractable domestic problems?

Democrats think that the answer is yes. "As conditions deteriorate, Americans are asking, 'Who can make it better? Where can we look for help?' And not surprisingly, government is increasingly the answer," said Peter Hart, a Democratic pollster.

Even Republicans see a growing unease as the driving force in the domestic policy resurgence.

"There's no question the economy is good, but it's not a good for everybody," said House Minority Leader John A. Boehner (R-Ohio.). "When you look at family incomes, there hasn't been much rise. But there has been increased health-care costs, increased energy costs. They're nibbling up more than the family budget. It just drives more concerns."

For both parties, domestic policy fights are a welcome break after three election cycles dominated by terrorism and war. Republican and Democratic political leaders say they cannot shy away from the Iraq war. But for much of the year, the fight over the war has only shown Democrats to be ineffectual and Republicans to be intransigent.

For Democrats, a break in that fight could allow them to focus on issues that voters say demand attention. Last year's election victories by Democratic Sens. James Webb in Virginia and Jon Tester in Montana, and by Democratic governors in Arkansas, Colorado, Iowa and Ohio, show that a populist message can prevail even in swing states.

For Republicans, changing the subject is simply a relief.

"I think it is territory that tends to unite us more," said Senate Minority Whip Trent Lott (R-Miss.). "Republicans tend to squabble, but when it's fiscal issues, when it's economic issues, we tend to come together. That's what makes us Republicans."

If so, the GOP may be having an identity crisis. Boehner, Senate Minority Leader Mitch McConnell (R-Ky.) and President Bush have met regularly on what Boehner calls his "rebranding" initiative: winning back for the GOP the mantle of fiscal discipline and limited government.

But in the first big domestic battle on Capitol Hill, 18 Republicans in the Senate and 45 in the House abandoned their leaders to side with the Democrats on a five-year, $35 billion expansion of the State Children's Health Insurance Program.

House Republicans are expected to muster enough votes to sustain Bush's anticipated veto of the SCHIP bill, but Boehner conceded that Congress is liable to override the promised veto on a $21 billion water-project bill so crammed with home-district projects that it has been denounced by taxpayer and environmental groups alike.

"There's deadlock on Iraq. Bush is intransigent. It's clear we're not going to get the 60 votes to change course on the war. But Republicans are hurting too, so they're breaking with him on all these domestic issues," said Sen. Charles E. Schumer (N.Y.), chairman of the Democratic Senatorial Campaign Committee.

Indeed, on the domestic front Republicans may be in the same bind that they face on foreign policy: Their conservative base is not where the rest of the country is.

For more than a decade, the Democratic polling firm Hart Research and the Republican firm Public Opinion Strategies have read two propositions to Americans: "Government should do more to solve problems and help meet the needs of people" and "Government is doing too many things better left to businesses and individuals."

In December 1995, at the height of the Republican Revolution, a less-intrusive government won out, 62 percent to 32 percent. This month, a more activist government won out, 55 percent to 38 percent. Independent voters sided with government activism, 52 percent to 39 percent.

But Republican voters, by a margin of 62 to 32 percent, still say government is doing too much.

"The big tectonic plates of American politics are shifting, and the old Republican policies of limited government aren't working like they used to," Schumer said. "Their problem is, the Republican primary vote is still the old George Bush coalition -- strong foreign policy, cut taxes, cut government, family values. But Americans aren't there anymore."

But the same poll did find some hope for the GOP, said Neil Newhouse, a partner at Public Opinion Strategies. Americans said they do not see a role for the federal government in the current mortgage crisis.

"Americans seem to be saying that the problems the country is facing demand a more activist government, but that this does not extend to all issues or every problem," Newhouse said.

That's a difficult needle to thread, but it can be done, said former senator Jim Talent (R-Mo.), a top domestic policy adviser to Republican White House hopeful Mitt Romney. Then-Texas Gov. George W. Bush showed in 2000, with his stand on education and his general slogan of "compassionate conservatism," that Republicans can win on traditional Democratic turf. They can do that again, especially on health care, Talent said.

"Part of what is at the core of the party is smaller government, fiscal restraint," said Sen. Mel Martinez (Fla.), general chairman of the Republican National Committee. "But like in this debate on SCHIP, it's very important that we as Republicans make it clear we are for insuring children."

"It's no longer permissible for us to think 47 million Americans being uninsured is okay," Martinez said.

Unpopular Congress enduring tough times (http://www.reuters.com/article/topNews/idUSN0923700020070710) By Steve Holland Reuters, Jul 10, 2007

WASHINGTON (Reuters) - These are tough times for the Democratic-led U.S. Congress, where partisan battles have led to little progress on big issues and have made lawmakers collectively less popular than President George W. Bush.

Congress, typically never all that popular to begin with, starts the second half of 2007 with an anemic job approval rating of about 25 percent, down from 43 percent in January, with one Gallup poll ranking lawmakers at 14 percent.

Experts attribute the woeful rankings to an inability to force a change in direction in Iraq, the priority Democrats campaigned on to gain power in both the House of Representatives and the Senate in last November's elections.

But that is not all. There has been little to show on other priorities, including a change in Social Security and other entitlement programs that will run out of money in the years ahead, in addition to overhauling a health care system that has left millions uninsured and a broken immigration policy.

"I think Americans were expecting a great deal from the new Congress, and Congress has always been held in low esteem, but Congress really hasn't delivered on what it promised, especially on Iraq," said Paul Light, a congressional expert who is a professor at New York University.

Democrats in charge of Congress insist they have made progress on several issues, like increasing the minimum hourly wage and getting money for victims of the 2005 Katrina hurricane. They blame the Republican minority for a failure on others such as immigration, greater energy independence, and on negotiation of lower-priced drugs for Medicare.

"I'm not really much for polls," said Senate Majority Leader Harry Reid of Nevada. "We're going to continue doing what we think is the right thing for the American public in spite of a White House and the Republicans who are stalling every step of the way."

    IRAQ DEBATE

Democrats drew a line in the sand over Iraq in the spring, using a $100 billion war spending bill to try to force Bush to accept a troop withdrawal date.

The effort failed miserably, with Bush finally getting what he wanted with no strings attached, and the White House saw the fractious debate as taking time away from work on other priorities.

"They've proven that they're not capable of taking on big issues," an administration official said.

Democrats beg to differ, pointing out that under their stewardship the Congress has resumed its traditional watchdog role over an administration they feel got off scot-free under Republican leadership.

"I would say in the first six months, gauging how things operate here from the majority, that we had some important work to do," said House Speaker Nancy Pelosi of California. "We had to drain the swamp. We had to create the oversight."

With American patience running thin over the Iraq war and casualties rising, Democrats may eventually force a change in direction in the unpopular war, an effort being renewed this week on Capitol Hill.

The Iraq situation has so infuriated the Democratic left that Cindy Sheehan, the California liberal who began a long protest against Bush after her soldier son Casey was killed in Iraq, is talking about running against Pelosi in 2008.

"I think the decline in support (for Congress) since the Democrats took over reflects in part the unhappiness of the base in the inability of Democrats to immediately stop the war in Iraq," said Thomas Mann, a congressional expert at the Brookings Institution.

The analysts say Congress' low poll numbers also reflect an altogether negative mood among Americans who are tired of the war, fed up with rising gasoline prices and worried about their jobs in a changing economy.

But how all this plays out in the 2008 election is hard to say. Incumbent lawmakers, while collectively held in low esteem, rarely fail to win re-election.

    Hi All,

Would like to know if anyone has any H1B extensions approved/RFE's/denied (whether regular or premium processing) after the January 8 USCIS memo. Please indicate whether full-time or consultant.

I applied for H1B extension - receipt date December 23rd, 2009. Upgraded to premium on January 21, 2010 (Jan 21 date updated in case status on USCIS website). Working as full-time - (empoloyer is not into consulting), Extension is for 3 years beyond 6 years, I-140 approved.

Also, anyone know how long does it take these days for extensions under Premium processing to be approved.

    Thanks

I have this very tough situation.

I have an approved I -140 from previous employer and 6 years is over in USA.
    I got a H1B transfer to a different employer last year ( 2009 ) based on this approved I 140 ( H1B was approved around Aug 2009 - given till March 2011 ).
Now I filed for another H1B transfer to another employer. But around September 2009, the previous I 140 was revoked ( this revocation is normal one and not for fraud ). I didn't know about that. So an RFE came for the new H1B transfer since my I 140 was revoked. I don't have a GC on file right now. I had the impression that normal revocation of I 140 doesn't effect H1B transfer. PLEASE HELP!! What are my options?

    Thanks in Advance,
    Knobby

From UPI: U.S. Latinos, feeling neglected by both parties, are discussing forming an independent "Tequila Party" force, leaders say. "I don't know if it's going to happen, but there's talk," Fernando Romero, president of Nevada's Hispanics in Politics, told the Las Vegas Sun. "There's discussion about empowerment of the Latino vote." The idea, being debated in Nevada and around the country, stems from frustration over the Democrats' inaction on immigration reform and feelings of being taken for granted. While I wouldn't put too much credence in this happening any time soon, it does raise the point that Latinos expect more...

Animal portraits are my "thing", so I don't mean to be overcritical... Try to get the animal's face in the light. The rooster's a good subject, and you got down to rooster height, which is really good, and you got him when crowing - a great behavior. Unfortunately, the face is in shadow, and that means you don't get the "catchlight" sparkle in the eye. Also, you often don't get the eye quite in focus, since autofocus works on contrast. A lot of faults in a protrait can be overlooked if the eye is sharp. In this case, you're focused on the neck feathers, not quite on the eye, so if you can reshoot it, try for getting light in the eye, and I think you'll like the results even more. Good luck & have fun with it!
