I am EB3 - Dec 2004 filer and there is no hope for few years that my date get current. i have filed another GC through my sister in May 2006 and that F4 category is moving quicker and expecting my priority date will be current in 5 years through my sister.
i have bought 2 Family house in Jersey City. now for my kids education we thought to move to India for 4 to 5 years until we get call for GC though my sister.
we are going to rent house - it's multi family near NYC. my landloard is willing to take care of it in our absence.
my Q is can i get B1 (Visitor visa) for 10 years , if we show that we have property in US and we may need to visit just to take check it ??
should we inform immigration officer about GC filed though my sister to assure that we will not stay in US longer, to get B1 visa?
can we get visitor visa before leaving USA? i mean convert from H1 to B1 for multi year?

Hi Ramya,
You can walk out of Wipro paying them nothing,
Have you signed any document or bond which is valid here in United states, then you might have to consult the lawyer otherwise if it is very staight froward case,
One sided bonds not going to last long in court,
Good luck.

HI,
Following is my case details -
Visa and I94 expiration date: 12 Sep 2009
Filed H1 extension: 11 Sep 2009
Extension denied: 18 Nov 2009
Left US: 15 Dec 2009
Refiled H1 Visa: 15 Dec 2009
Visa apporoved: 22 Dec 2009
What should my answer for following question in DS-156 as I left US within 30 days of receiving the denial letter?
Have you ever violated the terms of a U.S. visa, or been unlawfully present in, or deported from, the United States?
Thanks,
Naveen

HI All,
I currently work for a desi consulting company and applied for H1B Extension.I applied H1B Extension with Current Client Letter and also a copy of PO.But my contract may end in a month or so.I am near to finalising a new contract oppurtunity which if seleted needed to join immediately. Now if i change the job does it effect my pending H1B extension.
I am not changing my consulting company who holds visa i am only changing client. As i already submitted client letter and PO i am kind of nervous if i get RFE regarding the current client, which i may not be able to answer it.Waiting for your valuable feedback.

I'm glad to see Immigration Voice weighing in on this one. Under some of the versions of health care reform proposals being considered by Congress, legal immigrants could be excluded for five years before they can access the Medicaid and insurance subsidies despite the fact that they pay taxes, are abiding by all of our laws and are often making critical contributions to the success of this country.

From Immigration Law
On 04/11/2007, Senator Hagel introduced this special bill for a relief from the current H-1B visa crisis. The bill is now in the Senate Judiciary Committee. The full text of the bill has yet to be made available to the public. As soon as the bill, S. 1092 is available, we will post the detail. Please stay tuned to this web site.
Is this going to be just h1 ? or will EB GC related stuff be included ?
Is there any realistic chance that this will get thru ?

If you resigned, then I dont think company is liable for any severance. I work for a bank and they have a policy that they consider attrition due to visa issues (like unable to extend H1 etc) as termination for employment. They pay severance only for displacements which happens due to lay offs. I may be wrong and policy might be different in your company but just my 2 cents.

Hi,
Please advice me on below:-
1)I am on H1b visa and currently i am on bench. My 140 is approved and my H1b is expiring on sep30 ,2009. I got rfe for h1b extension asking for client letter.
Should i convert to h4 or do h1b transfer if i could be able to get someone to transfer it.
2) Also if I go to h4 visa will my green card processing with priority date remain same if i go back to same employer and ask them to file my h1b again after i get a project. Or they again have to start the process again even with same employer. Also what if i go with different employer.
3. If I apply for H4 visa now and in mean time i get a project before sep 30 2009, then what do I need to do. can i just ask my employer to again file h1b extension.
4) SO if I do h1b transfer or go on h4 what are the pros and cons.
Please let me know ASAP.
Thanks in advance.

Good find. I had apprehensions about the tax filing next year for 2008 but got it cleared here.
Q. Will the payment I receive in 2008 reduce my 2008 refund or increase the amount I owe for 2008?
A. No, the Stimulus Payment will not reduce your refund or increase the amount you owe when you file your 2008 return.

Is a person who was deported almost 30 years ago, and returned to the U.S. without inspection a year later subject to the permanent bar under the 1996 immigration law? The 1996 law created the permanent bar to the immigrating to the U.S. Section 212(a)(9)(C)(i)(II)provides as follows: "(C) Aliens unlawfully present after previous immigration violations.- (i) In general.-Any alien who- ...(II) has been ordered removed under section 235(b)(1) , section 240 , or any other provision of law, and who enters or attempts to reenter the United States without being admitted is inadmissible." The question is whether or not this...
