Hello,
I was wondering how long it took for everyone's check to be cashed once their packages were received at the TX service center? I'm worried because from what I read before the check cashing was almost immediate, while getting a receipt actually took longer. My package was received and signed for by Michael Salcedo on November 13th, but the check still hasn't cashed and I do not have a receipt. My husband and I are planning on travelling to Canada for Christmas, will crossing the border be a problem? Any advice anyone can give would be great! Thanks in advance!

Hi everyone,
I have come to this form for help of one thing: for a long time I know that when switching jobs using ac21 you need to make sure that the job code is same and job description is similar, i know from my approved 140&perm that mine is 15-1032 (computer engineer),
the job description of both company are 90% same.
But they know nothing about the job code and ask me what is this code and where this is used . Can somebody help me with this?
btw, my old job title is computer engineer, my new title is manager of computer system engineer. is that a problem ? if yes , if I asked them to demote that to computer system engineer leader, is it better?

Can i cancel appoinment one day before.
I saw in www.vfs-usa.co.in website ,have to cancel before two working days of appointment day.
If i cancel appointmentafter few days will i have to fill again DS156,157 forms for appointment.
In website they said cant cancel appointment 2 times.After 2 times cancelation have to wait 90 days with that hdfc barcode.
Before 90 days period can we fix new appoinment by paying agian into HDFC bank.Is this possible new appointment with new barcode.

I am on H1B 8th year extension, my priority date is September,2004. When I join new employer, Will I lose my current priority date as well as LC?
Depends on whether or not your I-140 is approved. If it is, and your old employer does not withdraw the petition then there is a possibility of carrying on with your old PD. I am no expert on this, but the issue has been discussed several times on this forum. Do a search for more info.

Hi,
I have been granted an asylum last year in July. I sent my I-485 to adjust my status this year on August 24th with the fee waiver form (sending proof of food stamp eligibility and supporting documents.)
Today is October 2nd(its been almost 40 days) and I have not received a document receipt from USCIS (we are a family of 3 and non of us has received anything in regards to this matter)
Please let me know what actions should I take or should i wait?! Is it possible to not get a receipt and just receive the finger print notice in the next few months?! (I just checked texas service center's processing times, and it says they are at March 28th,2010 now)

A friend of mine lost his I797. His lawyer asked him to apply for duplicate.He got the duplicate after few months. I don't know the exact procedure was.

Yes- you can start sole proprietorship on EAD and there is no need to inform USCIS. Only complications will be taxes, nothing else.
Sole Proprietorship should not become your main employer if you are main (primary) applicant of 485 application.

I had a H1-b visa until September 2008 from Company A. I transferred the H1-B to Company B and it was approved in December 2008. When I went for my stamping in March 2009 it was denied under 221(g). My employer then withdrew the H1-B petition because of lack of projects. I am now planning to apply for a B1/B2 visa at the Mumbai Consulate. Any one have a similar experience to share or have an idea on my chances of sucess?

Hi All ,
I am currently on L1B visa valid till Dec 25 2008 and current I-94 valid still July 2009.
I can't apply for I-94 extension until Jan 09.
I am travelling to india on Nov and will return on Nov 30 2008.
Is it advisable to go for Visa Stamping during Nov 08 or can i file my extension once i returned back to US on NOv 30 2008.My visa will be valid only for 25 days and want to know if that will create any issues.
Any views would be greatly appreciated.

I've received very good advice from IV members and hope to get this one sorted out here. My in-laws passed away within the last 2 years and wife's younger sister is stressed out. To cheer up we plan to bring her to US for 2 months. Her visa may get rejected for these reasons. No strong family ties in India since the parents passed away. She is an engineer (non-IT) but not employed and she is unmarried and no other siblings in India.
However she is a partner is her father's business and can show the documents as a proof.
What's the best way to get apply for visitor visa
1. I sponsor her visit, by sending bank statements, pay slips and employment letters etc.
2. She applies on her own and show her partnership documents, bank statements etc..
3. She goes through a travel agent like SOTC and book 10 day sightseeing trip and after which she could join us.
Obviously her sister being in US and no parents back home is a big red flag but we can't change that situation.
Any advice will be much appreciated.

I filed my 485 on June 4th 2007 with NSC. It was transferred to TSC and received my Receipt notice. Now I am going to file my AP.
My question is where should I file my AP?. Do I need to file with NSC or TSC?.

Folks, I'm in the current sitation. In 6th year of H1B, aplied for PERM labor pending with ATL processing center for >15 mtonhs. Attorneys are filing for 7th year extension. I need to traval in the next 2 weeks but not confident enough to get everything right, I need my visa stamped aswell, which with the current H1B validity, would be onlyuntil 22nd Oct 2009. I did try to convince my Managers that they file the extension under premium processing and I could get extended visa until Oct 2010, but Attorney advised that it is not necessary and I should be fine to go, get my visa stamped and come back.
2 points I'm concerned about are,
1. Since I have < 6 months validty on current H1B is it safe to travel and I would hopefully have my extsntion reciept number when I go for stamping.
2. Heard lot about denial of entry at POE, I'm trying to avoid certain airports that I has problems (JFK, EWR etc). Not sure I'm doing enough to be safe.
Any advise is greatly appreciated.

Yes, it is possible to obtain a Green card from L1B. However, you will have to undergo the Labor certification process (PERM application). Time wise there will not be a difference whether you apply under H1-B or L1B. It is only foreign nationals who are managers and executives on L1A status are eligible to apply for the green card without the labor certification.
